TERMS AND CONDITIONS OF USE OF THE STIB-MIVB MOBILE APPLICATION

1. INTRODUCTION
1.1 The STIB-MIVB and Purpose of the Application
The Société des Transports Intercommunaux de Bruxelles (hereinafter referred to as "the STIB-MIVB"), registered under VAT number BE 0247.499.953 in the Brussels Trade and Companies Register, with registered office located at rue Royale 76, 1000 Brussels, is an association governed by public law and is responsible for operating the urban public transport system within the Brussels-Capital Region.
Its structure and the organisation of its activities are governed by the Order of 22 November 1990 on the organisation of public transport in the Brussels-Capital Region and its implementing decrees.
The STIB-MIVB has developed a mobile application with the aim of enhancing the user experience on its network (hereinafter the "Application").
The purpose of the Application is to provide Users with access to information on all mobility solutions offered by the STIB-MIVB, as well as by other public transport operators (TEC, De Lijn, SNCB), potentially in a personalised manner, in real time or according to planned schedules.
The Application also allows Users to purchase digital transport tickets—subject to the online General Terms and Conditions of Sale available here—or to check the status of their MOBIB card, provided the card has been added to the Application.
All travel on the STIB-MIVB network is subject to the Rules of transport, available and downloadable on our website here.
1.2 General Terms and Conditions of Use
These General Terms and Conditions of Use (hereinafter the "GTCU"), concluded between the STIB-MIVB and any User, define the rules of use of the Application and establish the respective rights and obligations of the STIB-MIVB and the User.
The GTCU apply from the moment the User installs the Application on their Mobile Terminal and must be accepted during the initial installation of the Application. Once the Application is installed, the User accepts, without condition or reservation, any updates to the GTCU. If the User disagrees with an update, they may cease accessing and/or uninstall the Application.
These GTCU are available and may be consulted at any time via the Application settings.
The French and Dutch versions of these GCU are the only official versions and shall prevail in case of interpretation issues or discrepancies. The English version is a translation for information purposes only.
2. DEFINITIONS
2.1. Definitions
For the purposes of these GTCU, the following terms and acronyms shall have the meanings assigned below:
- "Application": refers to the STIB-MIVB mobile application developed and published by STIB-MIVB, which is available free of charge in app stores for the User to download onto their Mobile Device. It includes, among other things, content, software, programs, tools (e.g., navigation, programming), databases, operating systems, documentation, and all other elements and services it contains, including updates and new versions that may be provided by the STIB-MIVB.
- "User Account": refers to the digital profile created by a User for the purpose of managing their preferences, receiving personalized information from STIB-MIVB based on their personal use, and, where applicable, purchasing transport tickets. The STIB-MIVB User Account is unique and can be used across the following platforms : on the website www.stib-mivb.be and in the Application.
- "Content": refers to all the informative data of the STIB-MIVB, including the personalized of a User Account in the Application.
- "Favourites": refers to the Favourite stops and lines, and where linked to a User Account, favourite addresses.
- "Itinerary": refers to a journey to be made between two geolocation points using the mode of transport of one (or more) public transport operator(s) (SNCB, De Lijn, TEC and STIB-MIVB) or mobility service provider(s) (SNCB, De Lijn, TEC, STIB-MIVB).
- "Preference": refers to any option made available in the Application that allows customization of the home screen and language settings.
- "Mobile Terminal": refers to any computer configuration and any mobile device (such as a smartphone or tablet) on which the Application can be downloaded and from which the Application can be run via its operating system and/or on which the Application is used.
- "User": refers to any natural person, whether anonymous or identified through a User Account.
3. TERMS OF USE OF THE APPLICATION
3.1 Introduction
The use of the Application is free of charge. The equipment (including the Mobile Terminal), the material means enabling access to the App, and the costs of access to and use of the telecommunications network are the sole responsibility of the User.
Use of the Application is strictly limited to personal use by natural persons, excluding companies, associations, or groups.
Access to the Application is granted for an indefinite duration from its installation until the User decides to uninstall it from their Mobile Terminal.
3.2. Use of the Application Without Identification via a User Account
In the case of anonymous use (without identification via a User Account), certain traveller information will not be personalized, and some screens or parts of screens will be unavailable.
The following information is available (non-exhaustive list):
- Multi-operator Itinary planning within Belgium, including support from the departure point to the final destination and map visualization;
- Real-time or scheduled information on possible disruptions (lines) and waiting times at stops;
- Theoretical timetable information for other operators (SNCB, De Lijn, and TEC);
- Saving of favorite stops and lines.
This list may be updated at any time by the STIB-MIVB.
3.3. Use of the Application with Identification via a User Account
Any User logged in with a STIB-MIVB User Account will be able to access all the services offered by the Application, in a personalized manner based on their Favorites.
The User may benefit from the following features (non-exhaustive list):
Management of the User profile;
- Purchase of dematerialised transport tickets (digital tickets);
- Display of disruption alerts based on favorite and/or most frequently used lines and the User’s geolocation;
- Itinerary search history;
- Notifications for departure reminders and Itinerary start, etc. ;
- Viewing and modifying MOBIB card data, as well as the purchase of transport tickets to be loaded onto the card via a redirect to the website;
- Saving favorite lines, stops, and addresses.
Each User must use their own User Account, which cannot be shared. It is prohibited to disclose login credentials to third parties, to allow others to access one’s User Account, or to purchase transport tickets for multiple individuals using a single User Account. Any collective or shared use of the Application is strictly forbidden.
The User may delete their User Account at any time via the options available in the STIB-MIVB Application, via the account settings on the website, or by contacting the Customer Care service referenced in the “Contact” section of this document.
3.4 Additional Options
With appropriate permissions granted via Mobile Terminal settings, the Application may access:
- Contact list, to launch itinerary searches from/to saved addresses;
- Calendar, to launch itinerary searches linked to event locations;
- Location data, to display relevant local information (e.g., nearby stops, location cursor on the map).
4. USER OBLIGATIONS
The User expressly undertakes to:
- download and use the App on his Mobile Terminal exclusively on a personal and non-commercial basis;
- not to reproduce permanently or temporarily the App or the Content, in whole or in part, by any means and in any form;
- not to use any software or process intended to copy the Content without the prior, express and written authorization of the STIB-MIVB;
- not to make any adaptation, modification, translation, transcription, arrangement, compilation, decompilation, assembly, disassembly, transcoding, nor to apply reverse engineering, nor to use practices such as scraping or the use of robots for the purpose of extraction, reproduction of all or part of the App, the services and/or the Content;
- not to export the App, to merge all or part of the App with other computer programs;
- refrain from using software or devices likely to disrupt the proper functioning of the App;
- not to use the App in a way that is likely to disrupt the proper functioning of the App, nor to take any action likely to impose a disproportionate burden on the STIB-MIVB infrastructures;
- not to extract or re-use, including for private purposes, without prior, express and written authorisation from the STIB-MIVB, a substantial or non-substantial part of the Content of the databases and archives constituted by the App or which can be consulted via the App;
- not to set up systems likely to hack the App and/or the Content, in whole or in part, or likely to violate these GTCU;
- inform the STIB-MIVB as soon as they become aware of an act of piracy and in particular of any illegal or non-contractual use of the App and/or the Content, whatever the method of distribution;
- not communicate incorrect information or deliberately use another person’s User Account (identity theft);
- not to sell, rent, sub-license or distribute in any way whatsoever the App and/or the Content to third parties.
In general, the User undertakes to respect the laws and regulations in force and not to infringe the rights of third parties.
The User is solely responsible for any use that may be made of his login, his identifiers (including his email address) and password, and is the sole guarantor of their confidentiality, as well as any use of his User Account. The User undertakes to regularly update all information concerning him, in particular information relating to his User Account, by regularly resetting his password.
5. INTELLECTUAL PROPERTY
STIB-MIVB holds all intellectual property rights in and to the Content and the Application.
Access to the App does not confer any property right on the intellectual property rights relating to the App or any of its elements, which remain the exclusive property of the STIB-MIVB. Access to the App confers to the User a free, revocable, worldwide, non-transferable and non-exclusive right to use and consult the App for non-commercial and strictly personal purposes, within the limits of these GCU.
The Content is also protected by intellectual and industrial property rights held by the STIB-MIVB.
The STIB-MIVB intends to respect the intellectual property rights of third parties. However, if the User considers, in good faith, that the elements appearing on the App infringe the intellectual property rights of a third party, he is requested to contact the STIB-MIVB, by the various means of communication mentioned below, in the paragraph “Contact” of these GCU.
STIB-MIVB is committed to protecting your privacy and your personal data.
The processing carried out by STIB-MIVB varies depending on whether the User has a User Account or not.

7. LIMITATION OF LIABILITY
The obligations of STIB-MIVB in these GCU constitute a commitment of means. STIB-MIVB does not guarantee that the Application will be free from defects, errors, or bugs, nor that such issues will be corrected, nor that the Application will operate without interruption or downtime.
Without any express or implied warranty, STIB-MIVB aims to make the Application accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond STIB-MIVB’s control, and subject to possible outages and maintenance interventions necessary for the proper functioning of the Application, which will be kept to an absolute minimum, without any entitlement to compensation. Maintenance operations may be carried out without prior notice to Users and without any entitlement to compensation.
The availability of STIB-MIVB information within the Application has no impact on the operational availability of STIB-MIVB transport vehicles.
Similarly, all data concerning schedules and vehicle locations are as accurate as possible, but STIB-MIVB cannot be held liable for any discrepancy between the displayed position and the actual position of a vehicle in the field, or for the availability of a means of transport.
STIB-MIVB shall not be held responsible for any errors or delays in the updating of dynamic data, such as waiting times, which depend on telecom operators, or for any slight discrepancies with other STIB-MIVB displays.
Furthermore, STIB-MIVB shall not be held liable for any errors relating to data concerning data from third parties, such as the theoretical timetables of other operators (SNCB, De Lijn and TEC).
Finally, STIB-MIVB is not responsible for malfunctions attributable to third party software. Within the limits of the applicable law, STIB-MIVB disclaims all liability in this respect, in particular for any damage suffered, directly or indirectly, as a result of such failures.
Under no circumstances shall STIB-MIVB be liable for any type of foreseeable or unforeseeable damage, material or immaterial (including loss of profits or opportunity) resulting directly or indirectly from the use or total or partial impossibility of using the Application.
STIB-MIVB does not guarantee, and the User acknowledges and accepts this, the compatibility of the App with a Mobile Terminal, a hardware, a particular configuration, an Operating System (OS) or a specific version.
8. TERMINATION AND EXCLUSION FROM USE OF THE SERVICES
The STIB-MIVB reserves the right to exclude any User or to limit, restrict, suspend or close his access to the Application, without notice, at any time and unilaterally, including by immediate disconnection, in particular in the event of non-compliance with these GCU.
9. MISCELLANEOUS PROVISIONS
If one or more provisions of the present GCU were to be declared null, invalid or inapplicable in application of a law, a regulation or following a court decision that has become final, it will be deemed unwritten and the other provisions will remain applicable and will retain their full force and scope.
In case of difficulty of interpretation resulting from a contradiction between any title appearing at the head of the clauses and any clause, the titles will be deemed non-existent.
The fact that the STIB-MIVB does not apply or does not enforce any of the provisions of these GCU shall not be interpreted as a waiver of that provision or of any other provision of these GCU.
The STIB-MIVB reserves the right to transfer to a third party all or part of its rights or obligations in these GCU without the User’s consent. Such an assignment will constitute a modification to the present GCU and, if necessary, the User will be notified thereof.

11. APPLICABLE LEGISLATION
These GCU, and more generally the contractual relationship arising from the use of the Application, are governed by Belgian law.
Unless otherwise required by mandatory legal provisions, any dispute or disagreement between STIB-MIVB and a User in connection with or relating to these Terms of Use shall fall under the exclusive jurisdiction of the courts of the judicial district of Brussels, in the absence of an amicable resolution.
